01Who we are

This policy explains how Sculpette, a trading name of FLEXNEE LLC (14 Hughes, Irvine, CA 92618, United States), handles your personal information when you visit sculpette-au.com, place an order, sign up to our emails, or contact us. "We", "us" and "our" mean FLEXNEE LLC.

We handle personal information in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. You can reach us about anything on this page at support@sculpette-au.com.

The short version

We collect what we need to send you a parcel, answer your emails, keep the shop working, and show our ads to people likely to be interested. We do not sell your data. You can ask to see it, correct it or delete it at any time.

02What we collect

Depending on how you use the site, we may hold:

  • Contact and order details — your name, email address, delivery and billing address, phone number if you give one, and what you bought.
  • Payment details — the card type, the last four digits and whether the payment succeeded. The full card number never reaches us; it goes straight to the payment provider.
  • Account details — if you create one, your login and saved addresses.
  • Messages — anything you write to us, and our replies.
  • Reviews and photographs — if you choose to send them.
  • Device and usage data — IP address, browser, device type, the pages you viewed, what you put in your cart, and where you arrived from.

We do not ask for, and do not want, sensitive information such as health details. Our products are cosmetic, not medical, and nothing you buy tells us anything about your health. Please leave that kind of detail out when you write to us.

You can browse the site without telling us who you are. To place an order we need your name, email and delivery address — without them we cannot send you anything.

03How we collect it

  • From you — when you order, create an account, subscribe, write to us, or leave a review.
  • Automatically — through cookies and similar technology when you browse the site.
  • From our service providers — the payment provider tells us whether a payment cleared; Australia Post tells us where a parcel is.
  • From advertising platforms — Meta and Google may tell us, mostly in aggregate, that an ad led to a visit or a sale.

04Why we use it

What we do Why
Process and deliver your order To get the right parcel to the right address and keep you updated.
Take payment and prevent fraud To charge the correct amount and spot fraudulent orders.
Handle returns and refunds To honour the fit guarantee and your rights under the Australian Consumer Law.
Answer your messages So a real person can help you.
Keep business and tax records Because the law requires us to keep records of sales.
Send marketing emails Only if you asked for them — new shades, sizes and offers.
Advertise on Meta and Google To show our ads to people likely to be interested, and to measure whether they worked.
Improve the site To see which pages help and which confuse people.
Publish reviews you send us To show real customer feedback, with your permission.

We only use your information for the purpose we collected it for, or for a related purpose you would reasonably expect, unless you agree otherwise or the law requires it.

05Who we share it with

We do not sell or rent your personal information. We share it only with the service providers who help us run the shop, and only with what they need.

Who What for Where
Shopify Hosting the shop, storing orders and customer accounts. Canada, United States
Payment providers Taking payment and screening for fraud. They receive your card details directly. Australia, United States
Australia Post Delivering your parcel. They get your name, address and, if you give them, your phone or email for delivery notices. Australia
Our fulfilment partner Picking, packing and posting your order from our Sydney warehouse. Australia
Email provider Sending order emails and, if you subscribed, marketing. United States
Meta and Google Showing and measuring our advertising. United States, Ireland
Our own team Customer support and running the business. United States, Brazil

We may also disclose information where the law requires it, to establish or defend a legal claim, or to a buyer if the business is ever sold — in which case we would tell you first.

06Information that leaves Australia

As the table above shows, some of your information is stored or accessed outside Australia — mainly in the United States, Canada, Ireland and Brazil. Before we disclose information overseas we take reasonable steps to make sure the recipient handles it in a way that is consistent with the Australian Privacy Principles, including choosing established providers bound by contract to protect it.

You can ask us which safeguard applies to a particular provider.

07How long we keep it

What How long Why
Order and transaction records Up to 7 years after the order Tax and business-record laws require it
Customer account Until you ask us to close it, or 3 years after your last order So your addresses and history are there when you come back
Email correspondence 3 years after the conversation ends In case a return or a complaint resurfaces
Marketing subscriber list Until you unsubscribe, then a suppression record The suppression record is what stops us emailing you again by accident
Analytics and advertising data Up to 26 months In line with the platforms’ own retention settings
Reviews you asked us to publish Until you ask us to take them down Your permission

When a retention period ends we delete the information or de-identify it so it can no longer be linked to you.

08Cookies and tracking

Cookies are small files a website stores on your device. We use four kinds:

  • Strictly necessary — they remember your cart, keep you logged in and make checkout work.
  • Preference — they remember choices you make on the site.
  • Analytics — they tell us, in aggregate, which pages work.
  • Advertising — set by Meta and Google, they let us show our ads to people who visited, and tell us whether an ad led to a sale.

You can clear or block cookies in your browser settings, and opt out of personalised ads through your Meta and Google ad settings. Blocking the necessary cookies will stop the cart and checkout from working.

09Marketing

We only send you marketing emails if you asked for them — by ticking the box at checkout or signing up on the site — in line with the Spam Act 2003. Every marketing email identifies us and has a one-click unsubscribe link, and we act on it straight away and in any case within five business days.

Unsubscribing does not stop order confirmations, shipping notices or replies to your questions. Those are part of your order and we have to send them.

10Seeing and correcting your information

You can ask us at any time to:

  • Show you the personal information we hold about you.
  • Correct it if it is wrong, out of date or incomplete.
  • Delete it, where we do not need to keep it by law. We cannot delete a tax invoice inside the record-keeping period, but we can delete almost everything else.
  • Stop marketing — at any time, with no reason needed.

Email support@sculpette-au.com. We respond within 30 days and there is no charge. We may ask you to confirm who you are first, so that we do not hand your information to someone else. If we refuse a request, we will tell you why in writing.

11How we protect it

The site runs over HTTPS, card details go straight to the payment provider and never touch our systems, and access to the store admin is limited to the people who need it and protected by two-factor authentication.

No system is perfectly secure, and email in particular is not a secure channel. Please do not send us card numbers or passwords by email — we will never ask for them. If a data breach is likely to cause you serious harm, we will tell you and the regulator as the law requires.

12Children

This shop is for adults. You must be 18 or over to place an order, and we do not knowingly collect information about anyone under 18. If you believe a child has given us their details, write to us and we will delete them.

13Changes to this policy

We update this policy when what we do changes. The date at the top tells you when it last changed. If a change materially affects you, we will say so by email or on the site rather than quietly editing the page.

14Complaints

If you are unhappy with how we have handled your information, please tell us first at support@sculpette-au.com. We will acknowledge your complaint within one business day and aim to resolve it within 30 days.

If you are not satisfied with our answer, you can complain to the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au or on 1300 363 992.
